Man who attacked woman in Ann Arbor apartment pleaded no contest

WASHTENAW COUNTY, MI – A man has pleaded not guilty to assaulting a woman at an Ann Arbor apartment building.

Theophilus Smith, 44, pleaded guilty to assault with a dangerous weapon on Nov. 5 before Washtenaw County Magistrate Judge Carol Kuhnke. His other charge, assault rather than murder, will be dismissed at sentencing.

He will be sentenced before Kuhnke on January 14. He has a plea agreement with the county prosecutor’s office, according to court records.

Assault with a dangerous weapon is a crime punishable by up to four years in prison.

Smith is accused of assaulting a 40-year-old woman in a sixth-floor hallway of the Miller Mansion, 727 Miller Ave., on Oct. 14, 2023, police said previously. The woman, injured in her jaw, was taken to the hospital.

The attack was not random and the two knew each other, according to police spokesman Chris Page. Both were residents of the Ann Arbor complex at the time.

Police said no gun was used. The attack was captured on security cameras.

Smith is being held in the Washtenaw County Jail.
