Illegal tobacco sales lead to charges | News, Sports, Jobs

A Jamestown, NY man is facing charges for allegedly selling unlicensed tobacco products in Conewango Township.

The state Bureau of Enforcement and Taxpayer Assistance charged Michael R. Martinelli of Jamestown with two counts of unlicensed sales on Oct. 29. Big Puff’s, 2761 Market St., according to the state Department of Revenue. A check at Ext. ., The Town of Conewango alleged that the store was selling tobacco products without the proper license. However, a check on the state’s Open Data website claimed the business had a Cigarette/OTP Retail license that expires in February 2025.

“On or about the date in question, the defendant engaged in the over-the-counter retail sale of other tobacco products without possessing a valid Other Tobacco Products Retail licence.” the quote states.

Cigarettes can be legally distributed in Pennsylvania only by dealers licensed by the Department of Revenue. Tobacco Products Licenses are applied for through the Pennsylvania Online Business Tax Registration service. Wholesaler and Manufacturer licenses are $1,500 per location. Retailer licenses are $25 per location.
