No judge will be able to work in a particular place for more than 3 years: New policy

The draft Policy on Transfer and Appointment of Civil Court Judges, 2024, prepared by the Registry of the Supreme Court, proposes that any subordinate court judge should not be allowed to work in a particular place for more than three years.

“If the chief judge is of the opinion that any judge is busy with a special duty and that his transfer is likely to disrupt the administration of justice, that judge will be allowed to serve in the same workplace for a maximum of one more year.” The draft stated.

Chief Justice Dr Syed Refaat Ahmed, in his address to all judges, lawyers and judicial officers on September 21, had earlier focused on formulating a policy for appointment and posting of judges in lower courts, the Supreme Court administration said in a press release. Supreme Court Chief Secretary Aziz Ahmed Bhuiyan today (November 3) sent letters to all courts across the country asking them to send their opinions in writing via e-mail by November 7 ((email protected)) or WhatsApp at 01716185583.

According to the draft, no judge will be allowed to be transferred or assigned to a particular workplace more than twice in a row, and no judge will be allowed to be transferred or assigned to a specific workplace or district more than three times.

The draft stated, “No judge will be allowed to be sent to a workplace where his or her spouse, father, mother, brother, sister, father-in-law or mother-in-law works as a lawyer.”
