Man gets life sentence for co-accused, HIV/AIDS patient, for raping 14-20 year old Dalit girl

Agra: A special Pocso court in Agra sentenced a man to life imprisonment for raping a 14-year-old Dalit girl in 2022. HIV/AIDS He was sentenced to 20 years in prison, which was confirmed by medical tests performed in prison. Police said the survivor was also “infected” by him.
Special prosecution officer (SPO), Madhav Sharma told TOI on Sunday: “Both the men, Ram Sharma and the other accused have been sentenced to 20 years imprisonment. Pocso Lawand Sharma was given life imprisonment under the SC/ST Act. “The court imposed a fine of Rs 1,65,000 and Rs 1,15,000 respectively on Sharma and the other accused and directed that the entire amount should be paid to the survivor.”
“He also ordered that a copy of the order be sent to the district legal services authority for pursuit before the state government for compensation of Rs 5 lakh to the girl,” said Sharma.
While delivering the verdict, additional district court and sessions judge Parvez Akhtar observed that the crime committed by the convicts against minors “not only reveals their evil mindset but also reveals the lack of humanity in them.”
“Such crimes do not only restrict one person, they create fear for the safety of children in the entire society,” the decision said.
In the complaint filed at Shahganj police station on July 31, 2022, the girl’s father alleged that the 14-year-old boy left home after an argument and went towards Sikandra. There, on July 2, she encountered two strangers who sexually assaulted her after taking her to a nearby forest.
They also threatened him not to tell anyone about the crime, and one of them gave him a phone number to “keep in touch.” His family learned about the situation when his health began to deteriorate and he tested positive for HIV/AIDS.
The minor then described his ordeal in detail before the judge and police managed to track down the accused with the help of one of their phone numbers. An indictment containing technical and medical evidence was subsequently presented to the court on December 2, 2022.
DPT said, “10 witnesses testified at the hearing. The girl’s statement and the statements of the investigating officer and doctors played an important role in the capture of the suspects. The court convicted the two men based on the evidence on record.” — both in their late 20s.”
